Important: Please read these Terms of Service ("Terms") carefully. By accessing or using the Service (defined below), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. This is a legally binding agreement.
The Service provides a platform for You to connect your Gmail account, define custom labels and corresponding text prompts, and utilize an artificial intelligence model (Google Gemini LLM) to automatically classify and apply these labels to emails within your connected Gmail account. The functionality and features of the Service may evolve over time.
You must be at least 16 years old (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
You must register for an account using Google Sign-In. You agree to provide accurate and complete information via your Google profile and to keep this information up-to-date. You are solely responsible for maintaining the confidentiality of your Google account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal or internal business purposes during the term of your subscription.
Our Intellectual Property: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of MailMap and its licensors. The Service is protected by copyright, trademark, and other laws of both Finland and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.
Your User Content: You retain ownership of your User Content (your defined labels, prompts, and the underlying email data). However, you grant MailMap a worldwide, non-exclusive, royalty-free license to access, use, process, copy, distribute, perform, display, and modify your User Content solely for the purpose of providing, maintaining, and improving the Service for you, and as otherwise permitted by our Privacy Policy. This license includes the right to transmit User Content to Third-Party Services (like Google Gemini) as necessary to provide the Service's functionality.
Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us an unlimited, irrevocable, perpetual, sublicensable, royalty-free license to use such Feedback for any purpose without any obligation or compensation to you.
Subscription Plans: Certain features of the Service may require a paid subscription. We offer various subscription plans with different features and pricing, as detailed on our website mailmap.me/#pricing.
Payment Processing: We use Polar.sh as our third-party payment processor. By subscribing, you agree to provide accurate payment information and authorize us (through Polar.sh) to charge your chosen payment method for the subscription fees. Payments are subject to the terms and conditions and privacy policy of Polar.sh. We do not store your full credit card details.
Billing Cycle and Renewals: Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings or by contacting us before the renewal date.
Price Changes: We reserve the right to change subscription fees upon reasonable prior notice. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the Service after the price change constitutes your agreement to pay the modified fee.
Cancellations: You can cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. You will retain access to paid features until the end of the billing period.
Refunds: Subscription fees are generally non-refundable, except as required by applicable law (e.g., mandatory consumer rights in the EU) or at our sole discretion.
Taxes: Fees are exclusive of taxes, levies, or duties imposed by taxing authorities (like VAT), unless explicitly stated otherwise. You are responsible for paying all such taxes associated with your subscription. For users within the EU, VAT will be added as required by law based on your location.
The Service integrates with and relies upon Third-Party Services (Google APIs, Google Gemini, Cloudflare, DigitalOcean, Polar.sh). Your use of these Third-Party Services is subject to their respective terms and conditions and privacy policies. We do not control and are not responsible for the operation, availability, security, or practices of any Third-Party Services. Access to the Service may be interrupted or limited if the Third-Party Services become unavailable.
Specifically, the AI classification is performed by Google's Gemini LLM. We are not responsible for the accuracy, biases, or outputs of the AI model itself.
Our collection and use of your personal information are described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the data practices described therein, including the processing of your email content and metadata for the purpose of providing the AI labeling service.
You are responsible for ensuring that your configuration and use of the Service (including the prompts you define) comply with applicable data protection laws regarding the email content being processed.
We adhere to the Google API Services User Data Policy, including the Limited Use requirements, as detailed in our Privacy Policy.
Term: These Terms become effective upon your first use of the Service and remain in effect until terminated by either you or us.
Termination by You: You may terminate these Terms at any time by canceling your subscription (if applicable) and ceasing all use of the Service. You should also revoke the Service's access to your Google Account via your Google settings.
Termination by Us: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including, but not limited to, if you breach these Terms. We may also modify or discontinue the Service at any time.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account information and User Content (excluding data within your Gmail account itself) according to our data retention policies detailed in the Privacy Policy. Sections related to Intellectual Property, Fees (outstanding amounts), Disclaimers, Limitations of Liability, Indemnification, Governing Law, and Miscellaneous will survive termination.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
MAILMAP DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE SERVICE (INCLUDING THE ACCURACY OR RELIABILITY OF AI-GENERATED LABELS) WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; OR (E) THE AI CLASSIFICATION WILL BE ERROR-FREE, UNBIASED, OR ALWAYS APPROPRIATE.
YOUR USE OF THE SERVICE AND RELIANCE ON ANY INFORMATION OR CLASSIFICATION PROVIDED IS SOLELY AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAILMAP, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; ANY CONTENT OBTAINED FROM THE SERVICE (INCLUDING INACCURATE AI LABELS); OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF MAILMAP AND ITS AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO MAILMAP FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (€100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, ESPECIALLY IF YOU ARE A CONSUMER RESIDING IN THE EUROPEAN UNION.
You agree to defend, indemnify, and hold harmless MailMap and its affiliates, licensors, employees, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use of and access to the Service; (b) your breach of these Terms; (c) your User Content, including any claim that it infringes the rights of a third party or violates applicable law; or (d) your violation of any applicable law or the rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be primarily resolved through amicable negotiation. If a resolution cannot be reached through negotiation, such disputes shall be finally settled by the competent courts of Helsinki, Finland.
If you are a consumer residing in the EU, you may also be entitled to rely on mandatory provisions of the law of your country of residence and potentially bring proceedings in your country of residence or utilize the EU Online Dispute Resolution platform: http://ec.europa.eu/odr.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect (e.g., via email or a notification within the Service). What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
